Rental Agreement
CTX Epic Event Rentals Co.
1. ASSUMPTION OF RISK, WAIVER & RELEASE OF LIABILITY
I understand that the rental equipment (inflatables, tents, tables, chairs, games, etc.) and participation in related activities involve **inherent and serious risks** of property damage, bodily injury, permanent disability, paralysis, and death.
In consideration of being allowed to rent and use the equipment, on behalf of myself, my children, my guests, my heirs, assigns, and personal representatives, I hereby forever release, waive, discharge, and covenant not to sue CTX Epic Event Rentals Co., its owners, members, managers, employees, contractors, volunteers, and landlords (collectively “Released Parties”) from any and all liability, claims, demands, or causes of action arising out of any damage, injury, or death, even if caused by the negligence (active or passive) of the Released Parties or defective equipment.
I expressly agree this Release is intended to be as broad and inclusive as permitted by Texas law and that if any portion is held invalid, the balance shall continue in full force and effect.
2. INDEMNIFICATION & HOLD HARMLESS
I agree to indemnify, defend, and hold harmless the Released Parties from any claims, lawsuits, damages, or expenses (including reasonable attorney fees) brought by anyone (including my guests or minors under my supervision) arising from the rental or use of the equipment.
3. EQUIPMENT RESPONSIBILITY & FINANCIAL LIABILITY
Customer is the **sole bailee** and is **100% financially responsible** for the equipment from the time of delivery/set-up until CTX Epic Event Rentals Co. picks it up and confirms everything is returned in acceptable condition.
Customer will pay the **full current replacement cost** (not original rental price) plus lost rental revenue for any equipment that is damaged, destroyed, lost, stolen, or not returned — regardless of cause or fault (including weather, or vandalism).
**Prohibited items and actions:**
• Silly string, gum, candy, food/drink inside inflatables, animals inside inflatables, fireworks, paint, glitter, confetti cannons, climbing on tent frames, moving anchored inflatables, etc.
• **Pet waste on the event lawn/area:** Customer agrees to clean up all pet waste (dog, cat, or otherwise) from the set-up and play area before CTX Epic Event Rentals Co. arrives for pickup. Failure to do so will result in a mandatory **$150 pet-waste cleaning fee** automatically charged to the card on file. Repeated violations may result in refusal of future rentals.
4. SUPERVISION & SAFETY RULES
Customer agrees to provide **constant, competent adult supervision** at all times. Customer acknowledges receipt of (or access to) all safety rules and operating instructions and agrees to enforce them. Failure to supervise is considered negligence on Customer’s part.
5. WEATHER POLICY
CTX Epic Event Rentals Co. reserves the sole right to cancel or shut down equipment if wind exceeds 20 mph, lightning is within 10 miles, heavy rain, or any condition CTX Epic Event Rentals Co. deems unsafe.
• If CTX Epic Event Rentals Co. cancels **before delivery**, full refund or rain check.
• If Customer cancels or equipment is delivered, **no refund** for weather (including rain, heat, cold, or wind under 20 mph).
• Rain checks expire 12 months and are non-transferable.
6. CANCELLATION & RESCHEDULING POLICY
• >30 days before event → Full refund
• 15–30 days → 50% refund
• 8–14 days → 25% refund
• 0–7 days → No refund or credit
Deposits are **non-refundable** and non-transferable except for one rain-date rescheduling within 12 months (subject to availability and possible price increase).
7. DELIVERY, SET-UP & PICKUP
• Customer or adult representative (18+) **must** be present at delivery and pickup unless prior written waiver.
• Set-up surface must be grass or soft ground, clear of overhead wires, trees, and underground utilities (Customer call 811).
• Additional fees apply for stairs, elevators, distances >75 ft, gated communities, or parks requiring permits.
• Overnight/multiple-day rentals: Customer assumes **all risk** overnight (theft, weather, vandalism).
8. CREDIT CARD / DAMAGE DEPOSIT AUTHORIZATION
I authorize CTX Epic Event Rentals Co. to charge the credit card on file for:
⬛ Remaining balance Cleaning fees Damage / replacement costs
⬛ **$150 pet-waste cleaning fee**
⬛ Late fees ($100/hr after scheduled pickup)
⬛ Any other charges under this agreement
I understand charges may be processed up to 30 days after the event.
9. GOVERNING LAW & VENUE
This agreement shall be governed by Texas law. Any lawsuit must be filed in Bell County or Williamson County, Texas.
10. ENTIRE AGREEMENT / SEVERABILITY / ELECTRONIC SIGNATURE
This document constitutes the entire agreement. No verbal promises modify it. Electronic and/or copied signatures are binding.
